Terms & Conditions
These Terms & Conditions (“Terms”) govern your use of yourshinguard.com and your purchase of custom shin guards and related products from SAIWEI SPORTS. Please read them carefully before placing an order. By placing an order through our website, you agree to these Terms together with our Shipping Policy, Returns & Remakes Policy, Artwork Rights Policy, Privacy Policy, and any product-specific information displayed at checkout.
1. About SAIWEI SPORTS
SAIWEI SPORTS is the trading brand used by:
SAIWEI SPORTS is also presented as SaiWin in our logo and other brand materials. Both names refer to the same business operated by Fuzhou Saiwei Sports Technology Co., Ltd.
References in these Terms to “SAIWEI SPORTS,” “SaiWin,” “Saiwei,” “we,” “us,” or “our” mean Fuzhou Saiwei Sports Technology Co., Ltd.
2. Eligibility to Place an Order
You must be at least 18 years old and have legal capacity to enter into a contract in order to place an order.
If you place an order on behalf of a football club, academy, school, team, business, organization, or another person, you confirm that you have authority to place the order and to provide any names, logos, photographs, trademarks, artwork, or other content submitted with the order.
We may refuse or cancel an order where we reasonably believe that these requirements have not been met.
3. Products and Customization
SAIWEI SPORTS offers personalized shin guards, including products made using carbon fiber and PP plastic.
Depending on the product, customization may include:
- Personal photographs
- Player names
- Jersey numbers
- Text
- Team or academy logos
- Graphic artwork
- Different designs for the left and right shin guard
- Other customization options shown on the applicable product page
Product dimensions, materials, prices, available customization options, and other specifications are those displayed on the applicable product page at the time of ordering.
Size names may not correspond to identical physical dimensions across different materials or product ranges. Customers should review the applicable Size Guide before ordering.
4. Customer Artwork and Upload Rights
You must own, control, or have appropriate permission to use any photograph, logo, trademark, name, artwork, graphic, or other content that you submit to SAIWEI SPORTS.
You must not submit content that unlawfully infringes another person’s copyright, trademark, privacy, publicity, or other rights.
We may refuse to produce an order where we reasonably believe submitted artwork is unauthorized, unlawful, infringing, technically unsuitable, or otherwise inappropriate for production.
Customer-submitted artwork remains the property of the customer or its respective rights holder.
We will not use customer-submitted personal photographs, team artwork, or photographs of finished customized products for advertising, social media, portfolio use, website case studies, or other marketing purposes without the customer’s permission.
Customer artwork and design files are normally retained for up to 24 months to support order history, remakes, repeat orders, and customer service.
Customers may request deletion of eligible artwork and design files by contacting [email protected]. Certain transaction, accounting, fraud-prevention, legal, or compliance records may need to be retained where required by law or legitimate business obligations.
5. Order Submission and Acceptance
When you submit an order, you are making an offer to purchase the products shown in your order.
Full payment is normally collected when the order is placed.
Receipt of payment or an automated website acknowledgement does not necessarily mean that an order has been finally accepted for production.
An order may be subject to:
- Successful payment
- Complete and accurate customer information
- Review of uploaded artwork
- Availability of the selected material or product
- Successful preparation of the design proof
- Customer approval of the design proof
- Compliance with these Terms and our Artwork Rights Policy
We may decline an order before production begins if we are unable to produce it, the artwork is unacceptable, payment cannot be verified, the selected product becomes unavailable, or another legitimate production or compliance issue prevents fulfillment.
If we cannot accept an order and payment has already been received, we will issue an appropriate refund.
6. Prices, Currency, Payment, Taxes and Charges
We currently accept payment through:
Supported transaction currencies may include:
Unless otherwise stated, full payment is required when the order is placed.
Customers using bank or wire transfer are responsible for bank charges, intermediary bank fees, wire fees, currency-conversion charges, or similar payment costs. SAIWEI SPORTS must receive the required order amount before an order can proceed.
Shipping charges, where applicable, will be shown or communicated before the customer commits to the relevant transaction.
For international orders, customers are responsible for destination-country import duties, customs charges, VAT, GST, brokerage charges, clearance fees, or similar taxes and fees unless we expressly state that a particular charge has been collected or included.
We reserve the right to correct an obvious pricing or technical error before production begins. If an affected order cannot proceed at the displayed price, we will contact the customer and, where appropriate, cancel the affected order and refund the payment.
7. Design Preview, Revisions, Approval and Production Start
Personalized orders require customer approval of a design preview or proof before production.
The customer should carefully review the proof for:
- Correct photograph or artwork
- Image crop and positioning
- Left and right shin guard design
- Name and spelling
- Jersey number
- Text
- Logo
- Size
- Material
- Other visible customization details
Each order includes one free design revision before final approval.
Additional revisions may be subject to additional design charges where substantial additional work is required. Any additional charge will be communicated before the additional work proceeds.
Proof Approval
When you approve the final design proof, you confirm that the customization information shown in the proof is correct.
If the finished product accurately reflects an approved proof, an error contained in that approved proof — for example an incorrect name, number, photograph, spelling, or customer-selected design — will normally be treated as a customer-approved customization rather than a production error, subject always to any rights that cannot legally be excluded.
8. Production Times
For standard individual custom shin-guard orders, our current production targets are:
Weekends, public holidays, unusually large orders, team orders, artwork problems, payment delays, product availability, or exceptional production circumstances may affect these timeframes.
These are production targets rather than guaranteed delivery commitments unless we expressly agree otherwise in writing.
Team, academy, club, wholesale, or bulk orders may require separate production schedules confirmed for the specific order.
9. Shipping, Customs and Delivery
Current estimated transit times after dispatch include:
Transit times are estimates rather than guaranteed delivery dates unless expressly stated otherwise.
International DHL and FedEx shipments are normally sent on a DAP (Delivered at Place) basis unless another arrangement is expressly agreed.
Under this arrangement, the customer is generally responsible for destination-country import duties, VAT, GST, customs charges, customs clearance costs, brokerage fees, and similar destination charges.
Customs procedures may cause delays outside our direct control.
Customers are responsible for providing a complete and accurate shipping address, contact name, telephone number, and other delivery information.
If a package cannot be delivered because the customer provided an incorrect or incomplete address, refused delivery without a legally valid reason, failed to complete required customs procedures, or failed to pay destination charges, additional return or reshipping costs may be charged to the customer where permitted by law.
10. Delayed Orders
We aim to dispatch orders within the production timeframe communicated on the website or confirmed for the relevant order.
Occasionally, production or shipment may be delayed because of circumstances such as material shortages, carrier disruption, customs issues, unusually high order volume, equipment failure, severe weather, public holidays, force majeure events, or other circumstances outside normal operations.
Where applicable law requires us to notify you of a delay, obtain your consent to a revised shipment date, allow cancellation, or issue a refund, we will follow those requirements.
If we determine that we cannot reasonably fulfill an unshipped order, we may cancel the affected order and issue an appropriate refund.
Nothing in the cancellation rules for customized products removes any mandatory cancellation or refund right that arises because of a legally relevant shipping delay or failure to supply.
11. Changes and Cancellations
Because our products are personalized and production can begin quickly, cancellation rights depend on the stage of the order.
Before Final Proof Approval
You may cancel your order before approving the final design proof.
If cancellation is accepted before production begins, we will provide a full refund.
After Final Proof Approval
Final proof approval is the point at which the customized product enters production.
After final proof approval and production start, customized orders generally cannot be cancelled or refunded simply because the customer changes their mind.
After Dispatch
Orders that have already been dispatched cannot normally be cancelled.
These rules do not exclude any mandatory rights available under applicable consumer law, including rights relating to faulty goods, materially misdescribed goods, failure to supply, or legally protected shipping-delay situations.
12. Returns, Remakes, Faulty Goods and Transit Damage
Our products are personalized and made specifically for each customer.
Accordingly, customized products are generally not returnable for change of mind.
This does not affect rights relating to products that are defective, materially different from the approved design, damaged, incorrectly manufactured, or otherwise covered by mandatory consumer protections.
SAIWEI SPORTS Production Error
If we print or manufacture the wrong:
- Photograph
- Name
- Number
- Size
- Approved design
- Other customer-approved customization
because of an error made by SAIWEI SPORTS, we will normally provide a free remake and replacement shipment of the affected product.
Customer-Selected Wrong Size
If the customer selected and approved the wrong size and SAIWEI SPORTS supplied the size ordered, this is not normally treated as a manufacturing error.
A free replacement is not provided in this situation. We may, at our discretion, offer a discounted remake.
Transit Damage
If an order arrives damaged during transportation, please contact us and provide clear photographs showing:
- The damaged product
- The external packaging
- The internal packaging where relevant
- The shipping label where reasonably available
After verification, we will normally provide a free remake and free reshipment of the affected product.
If a remake is not reasonably available, we may provide a refund for the affected product.
Color Variation
Colors displayed on phones, tablets, monitors, and other screens can vary because of display settings.
Printed color may also vary slightly because of material properties, printing processes, coatings, lighting, and normal production tolerances.
Minor and commercially reasonable color variation is not normally considered a manufacturing defect.
However, this does not apply where the finished product materially differs from the approved design or where applicable law requires another remedy.
Reporting a Problem
Customers are requested to report manufacturing errors, transit damage, or other visible order problems within 7 calendar days after delivery so that we can investigate promptly.
This reporting request does not reduce or replace any longer period or mandatory right available under applicable consumer law.
Refund Processing
Where a refund is approved, SAIWEI SPORTS will normally issue the refund to the applicable original payment method within 7 business days after approval.
The customer’s bank, card issuer, PayPal, or other payment provider may require additional processing time before the funds appear in the customer’s account.
13. Product Use, Fit and Safety
Customers are responsible for selecting an appropriate product type and size for their intended use, subject to applicable consumer rights.
Sizing information and product guides are intended to help customers select an appropriate size but should be read together with the measurements shown for the specific product.
Shin guards are protective sporting equipment designed to help reduce certain impacts during football and related activities. No item of sports protective equipment can eliminate every risk of injury.
Customers should use the product appropriately and follow any care, sizing, fitting, or usage instructions provided.
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.
14. Intellectual Property
SAIWEI SPORTS and Fuzhou Saiwei Sports Technology Co., Ltd. retain applicable intellectual property rights in their own:
- Brand names
- Logos
- Original website content
- Original photography
- Product graphics
- Product designs
- Written content
- Website layout
- Other original materials
You may not reproduce, distribute, commercially exploit, or falsely represent our protected materials as your own without permission, except where permitted by law.
Customer-uploaded artwork remains subject to Section 4 and our Artwork Rights Policy.
We do not claim ownership merely because customer artwork is uploaded to our website or used in manufacturing.
15. Acceptable Website Use
You must not use our website to:
- Violate applicable law
- Infringe another person’s rights
- Upload malicious software or files
- Attempt unauthorized access to the website or its systems
- Interfere with checkout, payment, or website operation
- Submit fraudulent orders
- Abuse upload, email, contact, review, or support systems
- Misrepresent your identity or authority
- Submit unlawful or infringing customization content
We may block access, reject content, suspend processing, or cancel an order where reasonably necessary to protect our customers, business, systems, legal rights, or third-party rights.
16. Accuracy, Availability and Website Changes
We aim to keep product information, dimensions, prices, materials, availability, shipping information, and website content accurate and current.
Occasional typographical, technical, pricing, availability, or website errors may occur.
We may update website content, product ranges, future pricing, shipping options, policies, and services from time to time.
Changes made for future transactions will not automatically rewrite the terms of an already accepted order where applicable law does not permit such a change.
If a product becomes unavailable before production begins, we may offer an alternative, ask whether you wish to wait, or cancel the affected item and provide an appropriate refund.
17. Warranties and Mandatory Consumer Rights
Unless a separate written commercial warranty is expressly provided for a particular product, SAIWEI SPORTS does not offer an additional commercial warranty beyond the commitments expressly stated in these Terms and our Returns & Remakes Policy.
However, customers may have statutory or mandatory consumer rights that apply automatically.
Nothing in these Terms excludes, restricts, or replaces those rights where the law does not allow us to do so.
In particular, a “no change-of-mind return” rule for personalized goods does not mean that we refuse remedies for goods that are defective, incorrectly manufactured, materially misdescribed, or otherwise subject to mandatory consumer remedies.
18. Liability
Nothing in these Terms excludes or limits any liability, consumer guarantee, remedy, or other right that cannot lawfully be excluded or limited.
Our responsibility for defective, incorrectly manufactured, damaged, delayed, or undelivered products will be determined by these Terms together with any applicable mandatory law.
We do not make any representation that wearing shin guards or other protective sports equipment will prevent all injury.
Customers remain responsible for using products appropriately and selecting products suitable for their intended sporting activity.
To the extent permitted by applicable law, SAIWEI SPORTS is not responsible for loss caused solely by:
- Customer-provided incorrect information
- Customer-approved artwork errors
- Unauthorized customer-submitted content
- Customer misuse of the product
- Customer failure to follow reasonable customs or delivery requirements
- Events outside our reasonable control
Nothing in this section limits liability where doing so would be prohibited by law.
19. Customer Responsibility for Submitted Content
You are responsible for ensuring that content submitted for customization can legally be used for the requested purpose.
If a third party raises a credible intellectual property, privacy, publicity, or similar rights claim relating to content you submitted, we may suspend or cancel production while the matter is investigated.
To the extent permitted by applicable law, you are responsible for losses directly resulting from your knowing or unauthorized submission of third-party content in breach of these Terms.
This section is not intended to impose liability on a consumer where doing so would be unfair, unlawful, or inconsistent with mandatory consumer protection law.
20. Applicable Law and Dispute Resolution
Consumer rights can vary depending on the customer’s location.
Nothing in these Terms is intended to deprive a consumer of mandatory protections or access to courts or remedies that applicable law provides and does not permit the parties to exclude.
If you have a concern about an order, you should first contact:
We will attempt to resolve legitimate complaints directly and in good faith.
Unless and until SAIWEI SPORTS publishes a jurisdiction-specific dispute-resolution provision, these Terms do not impose mandatory private arbitration, a class-action waiver, or a contractual provision purporting to remove mandatory consumer jurisdiction rights.
The applicable governing law and competent forum for any dispute will be determined according to the applicable contractual and conflict-of-law rules and any mandatory consumer protections that apply.
21. Changes to These Terms
We may update these Terms when our products, services, business practices, legal obligations, payment methods, shipping arrangements, or website functions change.
Each published version should display its effective date and last-updated date.
Unless applicable law permits otherwise, changes to these Terms apply prospectively and do not automatically modify a transaction already completed under an earlier version.
Customers should review the version applicable at the time they place an order.
22. Severability, Waiver and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure by SAIWEI SPORTS to enforce a provision on one occasion does not necessarily waive the right to enforce it later.
These Terms, together with the applicable product information, checkout information, Shipping Policy, Returns & Remakes Policy, Artwork Rights Policy, Privacy Policy, and any specific written agreement relating to an order, form the contractual framework for the transaction.
Nothing in this section excludes legally binding representations, mandatory consumer protections, or other rights that cannot lawfully be excluded.
